What happens if you drive without insurance?

⚠️ A Crucial Warning for Parked Cars: If you have an old car that you no longer drive, you might be tempted to cancel your insurance to save a few euros. However, Portuguese law dictates that even if your vehicle is permanently parked on private property or in a garage, as long as it has valid license plates, it legally represents a risk. Therefore, you are still legally required to maintain minimum car insurance unless you officially cancel the vehicle’s registration (matrícula).

The Penalties: How much is the fine for driving without insurance?

If you are pulled over by the police (PSP or GNR) during a routine traffic stop and they discover your car is uninsured, you will face immediate and significant punishment.

Because driving uninsured is classified as a Serious Traffic Offense (Contraordenação Grave), the financial fines are incredibly heavy, generally ranging between €500 and €2,500.

Are there any other consequences besides the fine?

Yes. Paying the fine is just the beginning of your headache. If you are caught without insurance, the police will immediately apply the following sanctions:

  • Seizure of the Vehicle: The police will immediately seize your car on the spot. It will be towed to a municipal lot at your expense. You will not be allowed to recover the vehicle until you prove you have purchased a valid insurance policy and paid all the towing and storage fees.
  • Loss of Points: You will automatically lose 2 points from your driving license.
  • Driving Ban: Depending on your driving history, the authorities can suspend your driving license, legally preventing you from driving for a period ranging from 1 month to 1 year.

What Happens After a Car Accident Without Insurance?

Getting pulled over is bad, but getting into an accident without insurance is a financial nightmare. Here are three possible scenarios:

Scenario 1: You cause the accident and have no insurance

In this scenario, you will immediately face the €500 to €2,500 fine and the seizure of your car. But the financial pain doesn’t stop there.
Because you have no insurance to pay the victims, the Automobile Guarantee Fund (FGA)—a state-backed entity—will step in to compensate the injured parties for their medical bills and wrecked cars. However, the FGA does not forgive and forget. Once they pay the victims, the FGA will legally sue you to recover every single cent they paid out. You could be legally forced to pay tens of thousands of euros out of your own pocket, potentially resulting in the seizure of your bank accounts and assets.

Scenario 2: You are NOT at fault, but you have no insurance

Imagine you are waiting at a red light and someone rear-ends you. It is 100% their fault. Even so, because you are involved in an accident, the authorities will check your documents. Not having car insurance will force the police to issue you the massive fine, dock your points, and potentially seize your vehicle right there at the scene, entirely complicating your ability to claim damages from the at-fault driver.

Scenario 3: The other driver causes the accident and has no insurance

If you are hit by an uninsured driver, your situation is safely safeguarded by the state, provided you follow the correct steps. You must immediately call the police to the scene. Do not let the uninsured driver talk you out of calling the authorities. The police report is vital. You will then contact the FGA, who will ensure the payment of the compensation to which you are entitled to fix your car and cover your medical bills.
